Agenda Title:

Authorize the Mayor and Finance Officer to Sign a Waiver of Right to Protest a future assessment for the installation of curb, gutter, sidewalk, street light conduit, water, and sewer in Anamosa Street as it abuts a portion of the SW1/4NW1/4SW1/4 lying south of Harmony Heights Lane and less Tract B of Fountain View Subdivision, Section 26, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota.

Summary:

The waiver of right to protest (WORP) is associated with a Preliminary Subdivision Plan application (City File #14PL082) to plat two residential lots. Staff has approved an exception request (City File #14EX196) not to construct curb, gutter, sidewalk, street light conduit, water, and sewer in Anamosa Street adjacent to the plat at this time, contingent upon the property owner signing a WORP for the improvements. This segment of Anamosa Street is shown as an arterial street on the City’s major street plan and does not have any adjacent improvements at this time. Right-of-way is being acquired as a part of the plat for future roadway improvements.
